Step 2) Please review and sign the Customer Terms of Service Agreement

This Terms of Service Agreement (“Agreement”) is made by and between Fresh Clothes LLC, an Idaho limited liability company (“Fresh Clothes LLC”), and you, the customer (“you”, “your” or “Customer”).

Fresh Clothes, LLC is pleased to provide professional pick-up and delivery laundry services to our customers and offers quality and convenience at an affordable price. Our services are subject to the terms and conditions below. Your use of Fresh Clothes, LLC services (“Services”) indicates your agreement to be bound by the terms and conditions contained herein. Please read the following provisions carefully and let us know if you have any questions. We look forward to doing business with you!

Modification. Fresh Clothes, LLC reserves the right to modify this Agreement from time to time. You are advised to periodically review this Terms of Service for any such modifications. Your continued use of Fresh Clothes, LLC services shall constitute your full acceptance of such changes.

Confidential Customer Information. Fresh Clothes, LLC requires customers to provide certain registration details or other information prior to using Fresh Clothes, LLC services. It is a condition of the customer’s use of the services that all the information provided is current, accurate and complete. If Fresh Clothes, LLC believes the information provided is not current, accurate or complete, Fresh Clothes, LLC may deny access to services, or to any of its resources, and to terminate or suspend access and use without notice.

Confidentiality and Disclaimer. Fresh Clothes, LLC takes its customer’s privacy seriously. Fresh Clothes, LLC uses customer information to provide services, to process payment, facilitate billing, and for any other purpose reasonably necessary to provide services under this Agreement. From time-to-time, Fresh Clothes, LLC may send merchant service announcements, newsletters, and periodic notices about specials and new products. Fresh Clothes, LLC will not disclose customer information to third parties unless required by law necessary to enforce this Agreement or if necessary to protect the rights, interests, property or safety of Fresh Clothes, LLC.

Account Security. Customer is responsible for maintaining the confidentiality, security and maintenance of account information, including but not limited to login credentials (username and passwords or passcodes) and payment information. Customers are asked to notify Fresh Clothes, LLC immediately if account, login or method of payment has been lost, stolen, or otherwise compromised.

Customer Service Standards. Fresh Clothes, LLC is responsible for establishing routines with respect to your service needs, such as pick-up/drop-off schedules, specific laundering instructions and personal preferences. Each Fresh Clothes, LLC employee is held to high standards of customer service and quality performance established by Fresh Clothes, LLC. If you ever have a praise, problem or concern with your service, please do not hesitate to contact Fresh Clothes, LLC at the contact information provided herein. Fresh Clothes, LLC values your business and cares about providing excellent service to you.

Customer Obligations. As part of this Agreement, Customer agrees to the following conditions:

  1. Customer agrees to download and use the Fresh Clothes online mobile application.
  2. Customer agrees to ensure designated Fresh Clothes bin is outside and ready for pick up at customer’s scheduled pick-up time. Customer understands that Fresh Clothes will not pick up items that are not placed fully inside of the Fresh Clothes bin. Customer further acknowledges that failure to place bin outside at designated pick-up time will result in cancellation of services for that week.
  3. Customer agrees to return the undamaged, Fresh Clothes laundry bin at the conclusion of services. Customer agrees to pay a fee of $15 for each non-returned or damaged bin.
  4. Customer agrees to notify Fresh Clothes promptly upon customer’s decision to cancel services.
  5. If in possession of a Fresh Clothes Blue Bin(s) and with an account in “Active” Status, Customer agrees to use laundry service at least once per month at a minimum charge of $23.00 or more if specific care instructions have been agreed upon.

Pick-up & Delivery. Pick-up and Delivery will occur on a predetermined day and frequency, except on certain holidays, as determined by Fresh Clothes, LLC. Fresh Clothes, LLC recommends leaving items for pick-up in a concealed location to ensure the safety of such items. Fresh Clothes, LLC will deliver items in the same location as where they were picked up. Fresh Clothes, LLC assumes no risk of loss, damage or theft of items left unattended by the customer during pick-up or delivery.

No Show. If a customer misses a scheduled pick-up, the customer may be required to wait for the next Fresh Clothes, LLC pick-up day. Fresh Clothes, LLC reserves the right to impose a “no show” fee in the amount of $6.50 for customer’s failure to leave bin out for pick-up on scheduled day and time.

Payment. Service will not begin until Fresh Clothes, LLC has secured payment information. All payments are processed through Fresh Clothes, LLC’s secure online payment system. Customer authorizes payment for services by providing payment details. Fresh Clothes, LLC reserves the right to terminate a customer’s account and suspend services for non-payment.

Pricing & Modification. Fresh Clothes, LLC will maintain current pricing data on the Fresh Clothes, LLC website, available at: Fresh Clothes, LLC may, from time to time, modify its pricing for services. Any such modification will be disclosed to current customers in advance of providing services.

Referral Bonus. Fresh Clothes, LLC will award a (1) free Wash Dry Fold service for up to 30 pounds of laundry to any customers who refer our service. To qualify, please ask the person you have referred to let us know you sent them and we will contact you to award the service.

Additional Fees. In the event, a customer’s payment method is dishonored, rejected or otherwise not capable of being processed (“Payment Denial”), Fresh Clothes, LLC may assess additional fees to customer’s account for expenses incurred by Fresh Clothes, LLC as a result of such Payment Denial.

Garment Care. Fresh Clothes LLC desires to provide high quality laundering services and will use all reasonable precautions to avoid damage to clothes. Fresh Clothes, LLC however, is not liable for any damage due to normal laundering of items, cleaning of items without care instructions, dry clean items placed inside laundry bins, special-processing items (delicate-wash, air-dry, stain-treatment) not placed in a separate bin/bag, damage resulting from items left in the clothing, bleeding of colors, shrinking or any other alteration resulting from normal washing procedures.

Inventory Sheets. Customers are encouraged to submit an inventory sheet with each laundry bin. Fresh Clothes, LLC will notify customer immediately if there is any discrepancy between what appears on the inventory sheet and the items in the laundry bin. Such discrepancies may cause delays as we will not proceed with washing any items until we resolve the discrepancy with the customer.

Special Care Items. Fresh Clothes, LLC will follow any reasonable instructions provided by the customer, including water or drying temperatures. Customer acknowledges that items that have been air-dried (per customer request or Fresh Clothes, LLC’s determination for best garment care) may be damp upon delivery. Customer is responsible for any and all damage caused by any items left in the customer’s clothing or laundry bin that causes damage to customer’s clothing or Fresh Clothes, LLC property.

Labels & Stains. Fresh Clothes, LLC employees are not responsible for reading garment labels and providing special care to items, such as “dry clean only” items, which are included in the laundry bin. Although Fresh Clothes, LLC employees shall use their best efforts to remove stains, stain removal is not guaranteed.

Prohibited Items. Customer agrees not to include any of the following items inside their laundry bin (i) non-washable items, (ii) items that are labeled for dry cleaning only, (iii) items that have been exposed to bed bugs, (iv) items that have been exposed to or have come into contact with bio hazardous materials including, without limitation: feces, urine, blood, mold, mildew, lice and other bugs, irrespective of whether such contact or exposure resulted in visible; or (v) any other items not meant for laundering. Fresh Clothes, LLC may refuse to clean any garment at their sole discretion. Fresh Clothes, LLC is not responsible for loss of or damage to personal or non-cleanable items left in the clothing or laundry bags such as money, jewelry, or any other items.

Zippers. Zippers behave unpredictably while cleaning. Although zippers generally are not an issue, Fresh Clothes, LLC hereby notifies customer of the possibility of zipper issues, zipper damage and damage to other items as a result of the zipper’s inclusion in the cleaning process while following normal wash procedures, and Fresh Clothes LLC, does not accept any liability for such damage.

Re-Cleaning. Fresh Clothes LLC will re-clean items that, in its sole discretion, were not properly cleaned, and have not been worn since they were cleaned, at no additional cost.

Reporting Lost or Damaged Items. Customer is responsible for reporting missing or damaged items to Fresh Clothes, LLC within 24 hours of delivery of laundered clothes by emailing the following information to  (1) Order Number; (2) Name of item as set forth on the inventory sheet provided to Fresh Clothes, LLC; (3) Approximate age of the item; (4) Brief description of the condition of the item prior to incurring damage; (5) Brief description of the item’s condition and damage to the item after damage incurred; (6) Photograph of the item showing the damage; and (7) Receipt of purchase of the item or, when such receipt is not reasonably available, other reasonable proof demonstrating the value of the item at the time it was purchased. Customer’s failure to report the missing or damaged item(s) within 24 hours shall remove any liability of Fresh Clothes, LLC for the missing or damaged item.

Refunds/Credit for Services. Fresh Clothes, LLC shall notify the customer whether any refund or credit will be issued within five (5) business days after receiving notification of lost/damaged item from customer. Any refunds or credits shall be issued for the value of the damaged or lost item as specified in the National Fair Claims Guide from the International Fabricare Institute (“IFI”). This guide takes into account the average life of the garment, depreciation for the age of the item, and the current replacement cost. If the customer is unable to document the age of a garment, Fresh Clothes, LLC shall limit the maximum age of any garment to one year. If no current replacement cost is available, Fresh Clothes, LLC shall use the replacement cost of a comparable item currently available. All refunds/reimbursements offered by Fresh Clothes LLC to the customer, must be claimed by the customer within a 30-Day period. Once the 30-day period has expired, the customer’s claim will be considered resolved and closed.

Pre-Existing Damage. Fresh Clothes, LLC is not liable for any pre-existing damage to a garment or other item and reserves the right to return any item without cleaning it if any pre-existing damage is found or if Fresh Clothes, LLC has a concern about the colorfastness or the age or weakness of the fabric of such item.

Term & Termination. Either Fresh Clothes, LLC or the customer may terminate services at any time, for any reason and with or without notice. However, this Agreement shall continue in full force and effect until such time as Fresh Clothes, LLC or the customer notifies the other party in writing.

Limits of Liability. Fresh Clothes LLC’s liability shall be limited to general money damages in a maximum amount not to exceed the charges incurred by the customer during the term in which the damages are alleged to have occurred. This liability shall be the extent of Fresh Clothes, LLC’s liability regardless of the form in which any legal or equitable action may be brought and the foregoing shall constitute the customer’s exclusive remedy.


Dispute Resolution. If a dispute arises out of this Agreement or the relationship between the parties, the parties agree that prior to filing any lawsuit or complaint, the party must submit the dispute to an independent mediator, as agreed upon by the parties. The parties agree to enter mediation in good faith in order to resolve the dispute by such mediation and to comply with any settlement agreement reached therein. If mediation fails to resolve any matter between the parties, then either party may initiate suit in a court of competent jurisdiction. Fresh Clothes, LLC shall be entitled to reimbursement for its expenses, including court costs, and reasonable attorney’s fees, expenses and cost in any action against customer.

Nonenforcable Provisions. Each provision of this Agreement shall be interpreted in such manner to be effective and valid under any applicable law, but if any provision is held to be invalid, illegal or unenforceable, then such provision shall be removed without effecting the enforceability of the remainder of this Agreement.

Governing Law. This Agreement shall be governed in all respects by the laws of the State of Idaho. The parties hereto hereby consent to the jurisdiction of the courts of the State of Idaho and venue in Ada County and each party waives all objections to convenience of forum.

Force Majure. Neither Customer nor Fresh Clothes LLC shall be liable to the other for any failure or delay in its performance due to any cause beyond its control, including acts of war, acts of God, earthquake, riot, sabotage, labor shortage or dispute, internet interruption, government acts, and other similar events.

This Agreement contains the complete terms and conditions that govern your use of services provided by Fresh Clothes, LLC. By utilizing Fresh Clothes, LLC’s services, you agree that you have read, understand, and agree to be bound by this Agreement.
